They need to sit down and look to put practical measures that dont inconvenience people, but in the end all the public should be in charge of protecting themselves and never dropping any freedom for a false sense of protection. So, for a more direct answer, its no, the government shouldnt do anything, the people should decide what to do, and I wouldnt give up anything to maintain safety, theres no such thing.

It can be concluded that violation of the law on insider trading involves penalties, which could reach up to three times the profit the violators realized from the illegal insider trading under Sections 10 and 14 of the Securities Exchange Act of 1934. In addition, criminal penalties may also be imposed[4]. In this particular case, however, there is no mention about the criminal penalties, which may have been filed under a separate proceeding or court that will have jurisdiction on criminal case covered by the law. The Chief Operations Officer’s Essay The Chief Operations Officer’s role focuses on the execution of day-to-day operations and oversight of all the departments; to include morale, welfare, and employee conduct in the company. In order for the company to successfully prepare for an Initial Public Offering we will need to revise the employee handbook, resolve some specific internal employee matters and implement a whistleblower policy. Employment-at-will refers to common law which holds employees that work for an unspecified time period work at the will of their employers and employment can be dismissed any time (Zachary, 2012, p. 25), for good cause, bad cause or no cause, by either the employer or the employee. Some exceptions of dismissal for employment-at-will include discrimination against race, national origin, color, religion, sex, age, and disability, other exceptions are wrongful discharge in violation of public policy or breach of contract, the promise of â€Å"good faith and fair dealing† in a contract of employment or suggesting contractual requirements based off of the company’s handbook or policy statement (Halbert Ingulli, 2012, p. 50), and tort whether the policy is found in legislation, constitutions, legal hearings, administrative practices, or other sources (Zachary, 2012, p. 25). The tort law offers the employee the chance to convince a jury to award damages (money awards) for â€Å"wrongful discharge† (Halbert Ingulli, 2012, p. 51). Some state and federal statutes may also prohibit the discharge of employees for their participation in jury duty, filing workers compensation claims, involvement in the union, conducting military duty or certain occurrences in whistle-blowing (Zachary, 2012, p. 21). Our company operates off of voluntary employment; therefore, general counsel reviewed the employment-at-will doctrine and exceptions mentioned above and legal termination is an option for all eight employees based off of either personnel misconduct or violation against our company’s rules and regulations cited in the employee handbook. Table 1, titled, â€Å"Employee Conduct and Rational for Termination or Continued Employment†, illustrates the eight personnel actions under investigation and the decision for termination or continued employment. The decisions to terminate or retain the employees stem from a reflective approach that melds traditional theories and modern theories of ethics. Two particular theories that support the decision are the consequences-based approach which provides the greatest good to the majority of the people, in this case, the company as a whole and the Proactive theory decision based off of recommendations or actions are just from the very start (Harcourt, Hannay, Lam, 2013, p. 312). One of the decision rules from the Proactive theory used is the parity rule which ties all similar actions performed in a similar environment receive the same or similar consequence (Harcourt, et al, 2013, p. 313). If the company is to become successful with the launch of the public offering then employees must be accountable for their actions of misconduct or violations against the company employee handbook. In addition to personnel actions mentioned above, I recommend we adopt a whistleblower policy based off the internal allegations against the accounting department for falsified expense reports and before we take the company public. Implementing a whistleblower policy will provide the employees a voice of the company, reduce monitoring expenses, stimulate additional decision-making (Moberly, 2012, p. 11) among employees, supervisors, and senior management, will protect against illegal conduct and provide greater oversight of company resources and assets (Shackelford, 2009, p. 3). Furthermore, the Securities and Exchange Commission and the New York Stock Exchange issued regulations under the Sarbanes-Oxley Act that listed companies must provide their Codes of Ethics to the public (Moberly, 2012, p. 19). Our commitment to the workforce is to implement a whistleblower policy that focuses on the three fundamental items of clear guidelines, policies, and procedures (Gould, 2009, p. 3) for reporting organizational misconduct. Our whistleblower policy and Code of Ethics should be included in the revised employee handbook, posted on the company website and a hardcopy distributed and signed by each employee. The policy guidelines should contain our objective and scope of the policy so we can address what we want to accomplish (Shackelford, 2009, p. 3). Our policies will indicate that all employees, hourly to senior level management salary employees, are required to report organizational misconduct and to assist in any investigation by law enforcement or regulatory agency. Step-by-step reporting procedures will also be included in the policy. Employees will have the right to submit the report directly to their first line supervisor unless that individual is involved in the matter then report the situation to the next supervisor in the chain. If employees feel uncomfortable using their direct reporting chain then they can submit the report through the company action hotline, anonymously or directly to the audit committee. The individual’s confidentiality will remain as confidential as practicable (Shackelford, 2009, p. 3). Our company encourages the employees to report the wrongdoing internally through the use of our open-door policy or through the various avenues aforementioned rather than blowing the whistle externally. Our company will not tolerate retaliation against employees reporting wrongdoing or whistleblowing. In conclusion, as the Chief Operations Officer, I reviewed the employment-at-will doctrine, conducted and resolved eight thorough employee investigations that required my immediate attention, and provided background information that supports my recommendation on implementing a whistleblower policy prior to our public offering.

For one thing, the prices of tobacco, the major economic base of the colonies, were falling fast. To add to the decrease in tobacco price, Great Britain was also increasing taxes on the Americans. This did not help the situation in the colonies. Adding to all the turmoil, was a corrupted government. With William Berkeley as the current royal governor, he was in complete control of the colonies, and had not allowed an election in almost fourteen years. The Americans wanted a representative and responsive government, in which they could elect their representatives and have a voice in the government. With many of the tribes shifting territories, the American Indians were attacking planters along the frontier. By 1676, more than 300 Virginians had been killed at the hands of the Indians. Adding to all the turmoil, was a corrupted government. With William Berkeley as the current royal governor, he was in complete control of the colonies, and had not allowed an election in almost fourteen years. His only helpful action was to have more forts constructed, making planters feeling abandoned. The government was corrupted, and Great Britain was doing nothing to help. The Americans wanted a representative and responsive government, in which they could elect their representatives and have a voice in the government. From England came a man called Nathaniel Bacon, who was seen by the dissident planters as a natural leader. He is appointed to the Council by Berkeley, and later agrees to lead the planters in their fight against the Indians. He does wait for permission from Berkeley, and leads his followers 200 miles south, where he engages in a bloody battle with the Indians. At hearing this, Berkeley dismisses bacon from the Council, and claims his followers to be rebels. Despite his accusations, he cannot catch bacon and his force.

How Does Music Affect Our Lives: The Connection between Communication and Music Music is present throughout our lives, from the moment we wake up and hear that song that starts our day off, to that song that reminds us of that relationship we once had with that special someone, or a song that a city uses as its anthem for it’s sports team or a song that a country listens to, that helps comfort them in a time of tragedy and loss. Music helps us communicate and relate to things when we can not find the words to help us express our feelings. When we have had a tragedy in our lives some people turn to alcohol, drugs, or something else to get rid of a terrible memory. After the attacks of September 11th music was used as instrument in rebuilding the lives of the many New Yorkers who had lost loved ones, or had witnessed the horrific events. Bruce Springsteen was one artist that released an album at this time; the album was titled The Rising. This album conveyed the feelings of the citizens of New York City. Some of the tracks were titled, â€Å"Into the Fire†. â€Å"You’re Missing† and â€Å"Lonesome Day† We also had Sir Paul McCartney’s Freedom a song that was used as a memorial for the 9/11 attacks. Another band that helped heal the wounds of 9/11 was U2. Since the beginning they have written songs that reach a wide variety of fans from all over the world. One song that sticks out is, â€Å"Pride (In the Name of Love)† these lyrics talk about many great figures throughout history, including Jesus Christ, Martin Luther King Jr. and Gandhi. These are some of those lyrics. My uncle was murdered in the fall of 2002. Everyone including my grandmother took it hard. They song my cousin chose for her father was Free Bird by Lynyrd Skynyrd. Music has been there for me when I have no one to talk to. In the book Popular Music and Communication by James Lull there is a paragraph that explains musicians and how they communicate to their fans, â€Å"Popular musicians are loved, even worshiped, not only for their abilities to write songs and perform them publicly, but for their ability to â€Å"speak† to their audiences. Even an artist whose only contact with the audience is through the sale of millions of compact discs and tapes communicates â€Å"personally† with each listener† Pg. 33 of Popular Music and Communication by James Lull Sage Publications, C 1992. Everyone has a soundtrack to their lives and I found the first part of mine in 2000 with an album by a band named Papa Roach. My mother and father are separated; there divorce was based on the fact that my father was abusive towards my mother. The one song I could strongly relate to on that album was a song titled â€Å"Broken Home† I can't seem to fight these feelings I'm caught in the middle of this My wounds are not healing I'm stuck in between my parents I wish I had someone to talk to Someone to I could confide in†¦ Broken home All alone I know my mother loves me But does my father even care If I'm sad or angry You were never ever there When I needed you I hope you regret what you did I think I know the truth Your father did the same to you†¦ (Infest, Papa Roach, April 25, 2000, DreamWorks Records) When I heard this song it really opened my eyes, for the past sixteen years of my life I never knew that my fathers father had left when he was very young, it was a revelation to me, that this man who is my grandfather, that I have only seen a few times in my life, and my father were one in the same. After recently ending a relationship with someone that had truly changed my life I continue to listen to this song from a popular punk rock Band MxPx. The song is about someone giving up on girls and relationships and joining G. S. F. â€Å"Girls Schmirls Foundation† â€Å"You didn't have to be so mean to me I guess now I see how it's gonna be I'm joining GSF, I've made up my mind Forget this thing called love, it's a waste of time Girls ain't no good anymore, anyway! Music is also used to help boost morale in teams and fans at sporting events. Once a Spurs fan hears, â€Å"Are You Ready for This? † they automatically begin to get hyped for the preceding game. The same is at football games, especially college football games. When the fans at Texas State hear â€Å"Go Bobcats† they automatically get on there feet and begin to participate in the hand gestures and sing the chorus. The football team, whether win, lose or draw will be on that field singing the Alma Mater. There are those fan jams that are required at any sporting event, such as Queens â€Å"We Will Rock You† and â€Å"We are the Champions† Music is used at these events to get a crowd hyped and the teams pumped and excited that they are playing in front of a large group of people that believe in them. As you can see Music is all around us. It is apart of our lives. It helps us express our feelings towards other people, it helps us to close old wounds made by tragic events, it also give us a reason to cheer and sporting events, but the most important thing music gives us is a voice, a reason, a definition of who we real are. The sheer size of the prison system lends itself to many layers of profiteering. As many as 90% of jails charge prisoners various fees during their incarceration. These fees range from charges for medical care, booking, transportation--even housing fees, among others. In fact, in order to pay for the fees assessed by the prison, the friends and family members that send money to prisoners have to pay exorbitant fees, as high as 45%. Some of the largest banks, Bank of America and JPMorgan Chase, are able to profit from this exploitive practice because they have a monopoly on money transfers to prisoners which they obtained through no bid government contracts. Corizon, America’s largest prison healthcare contractor, earns about $1.4 billion in revenue annually. They’re able to maximize their profits, in a predictable manner, by neglecting the services that are expected of them. For example, they refuse to treat Hepatitis C. â€Å"We save money because we skip the ambulance and bring them right to the morgue,† says Diane Jackson, nurse for Corizon. There is also a $1.2 billion market for the few companies which contract for prison inmate phone calls. Those calls are charged at rates far above market prices, as much as $17 for a 15 minute call. Plenty of corporations also profit from extremely cheap prison labor. Prison laborers are typically paid about $1 an hour. Many are paid nothing, but they can earn time off of their sentence.
